8:30am-9:30am WHD | Employment Relationship -Recognizing the difference between employees and independent contractors
Misclassification of workers as independent contractors can unwittingly cause employers to violate a wide range of labor laws, including the labor standards provisions of the DBA or SCA, the Fair Labor Standards Act, and even the Family Medical Leave Act. This module will discuss how the employment relationship is defined and determined under these labor laws and assist employers to evaluate their own workforce for signs of misclassification.

The FMLA presentation summarizes key FMLA provisions and focuses on the areas of most significance, including employer coverage and employee eligibility requirements, serious health conditions, intermittent leave usage, employer and employee notice requirements, and the medical certification process.
10:00am-11:00am LWC | Employers Take Charge - An Overview of UI Basics
The Louisiana Workforce Commission is an agency of state government that administers programs designed to enhance workforce growth and provide family-sustaining jobs for Louisiana residents. The commission monitors employment, administers unemployment compensation and tax funds, provides training resources for employers and employees and oversees worker compensation benefits. The agency also gathers and supplies information on the labor market and occupational sectors in Louisiana.11:00am-11:15am Break

Under the Occupational Safety and Health Act of 1970, employers are responsible for providing safe and healthful workplaces for their employees. OSHA's role is to ensure these conditions for America's working men and women by setting and enforcing standards, and providing training, education and assistance.

At the Office of Federal Contract Compliance Programs (OFCCP), we protect workers, promote diversity and enforce the law. OFCCP holds those who do business with the federal government—contractors and subcontractors—responsible for complying with the legal requirement to take affirmative action and not discriminate on the basis of race, color, sex, sexual orientation, gender identity, religion, national origin, disability, or status as a protected veteran. In addition, contractors and subcontractors are prohibited from discharging or otherwise discriminating against applicants or employees who inquire about, discuss or disclose their compensation or that of others, subject to certain limitations.

The National Labor Relations Board is an independent federal agency created by Congress in 1935 to administer the National Labor Relations Act (NLRA). The NLRB protects the following rights of employees:
a) The right to engage in concerted protected activities, which are group activities that employees are involved in to try to improve working conditions, wages, and benefits.
b) The right to engage in union activities.
c) The right not to engage in concerted protected activities or union activities.
